Welcome to 1632 Wellness Club.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “Member”, or “Guest”) and 1632 Wellness Club (“1632”, “we”, “us”, or “our”) governing your access to and use of our website, booking systems, facilities, memberships, wellness services, digital platforms, and related offerings (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, Waivers, Intake Forms, and all additional policies referenced herein.

If you do not agree, you may not use our Services.

2. IMPORTANT LEGAL NOTICE

By using our Services, you acknowledge that:

  • You are at least 18 years of age (unless explicitly approved otherwise in writing)

  • You understand wellness services involve inherent risks

  • You voluntarily assume all risks associated with participation

  • You are legally capable of entering into binding agreements

  • You agree to all terms, waivers, and policies

3. ELIGIBILITY

You agree that:

  • Services are intended for adults 18+

  • Certain services (including IV Therapy and HBOT) require additional eligibility screening

  • You are responsible for ensuring participation is appropriate for your health condition

  • We may refuse service at our discretion for safety reasons

4. WELLNESS DISCLAIMER

All Services provided by 1632 Wellness Club are non-medical wellness experiences intended for relaxation, recovery, and general well-being.

We do not provide medical diagnosis, treatment, or healthcare services.

5. INDEPENDENT MEDICAL PROVIDERS

Certain services, including IV Therapy and related medical wellness services, may be provided by independent licensed healthcare professionals or third-party providers.

These providers operate independently and are solely responsible for their medical judgment, treatment, and compliance with applicable laws.

1632 Wellness Club is not responsible for medical services provided by third parties.

6. ASSUMPTION OF RISK

You acknowledge and assume all risks associated with participation, including but not limited to:

  • Physical strain

  • Heat or cold exposure

  • Pressure-based therapy (HBOT)

  • Mechanical devices 

  • Electrical or electromagnetic stimulation (PEMF)

  • Allergic or adverse reactions

  • Dizziness, fainting, or discomfort

  • Injury or illness

Participation is voluntary.

7. BOOKINGS, CANCELLATIONS & REFUSAL OF SERVICE

We reserve the right to:

  • Refuse service

  • Reschedule appointments

  • Cancel bookings

  • Modify availability

Cancellation policies may include fees, forfeitures, or restrictions.

Failure to comply may result in loss of access or membership privileges.

8. MEMBERSHIPS

Memberships may include:

  • Recurring billing

  • Automatic renewal

  • Usage limitations

  • Non-transferability

  • Freeze or cancellation policies

We reserve the right to modify or terminate memberships for violations or misuse.

9. PAYMENTS

You authorize us to charge all applicable fees including:

  • Memberships

  • Services

  • Late cancellations

  • No-shows

  • Retail purchases

  • Taxes

All sales are final unless otherwise required by law.

10. FACILITY RULES

You agree to:

  • Follow staff instructions

  • Use equipment responsibly

  • Maintain respectful behavior

  • Avoid intoxication or impairment

  • Comply with safety policies

We may remove any guest for violation of rules.

11. MEDIA RELEASE

You grant 1632 Wellness Club permission to capture and use photos, videos, or likeness for marketing, promotional, or business purposes unless you explicitly opt out in writing.

12. INTELLECTUAL PROPERTY

All branding, content, designs, systems, and materials are owned by 1632 Wellness Club and may not be copied or used without written permission.

13. PRIVACY & COMMUNICATIONS

Your use of Services is subject to our Privacy Policy.

By using our Services, you consent to:

  • Email communications

  • SMS notifications (appointments, reminders, updates)

  • Marketing communications (optional opt-out available)

14. THIRD-PARTY SERVICES

We may use third-party providers including booking systems, payment processors, and medical professionals.

We are not responsible for third-party systems or services.

15. FORCE MAJEURE

We are not liable for delays or failure to perform due to events beyond our control, including:

  • Natural disasters

  • Government restrictions

  • Equipment failure

  • Utility outages

  • Provider unavailability

16. DISCLAIMERS

Services are provided “as is” and “as available.”

We make no guarantees regarding:

  • Results

  • Availability

  • Outcomes

  • Performance

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid by you in the last 30 days.

18. INDEMNIFICATION

You agree to indemnify and hold harmless 1632 Wellness Club from any claims arising from:

  • Your use of Services

  • Your conduct

  • Violation of Terms

  • Injury or damage caused by you

19. DISPUTE RESOLUTION

Before arbitration, parties agree to attempt informal resolution in good faith.

If unresolved, disputes will be resolved through binding arbitration in New York State.

You waive:

  • Jury trial

  • Class actions

  • Collective claims

20. GOVERNING LAW

These Terms are governed by the laws of the State of New York.

21. MODIFICATIONS

We may update these Terms at any time.

Continued use constitutes acceptance.

22. SEVERABILITY

If any provision is found invalid, remaining provisions remain in full force.

23. ENTIRE AGREEMENT

These Terms, along with Privacy Policy, Waivers, and related policies, constitute the full agreement between you and 1632 Wellness Club.
